What is asylum?
To qualify for British Citizenship, you will need to:
Asylum and refugee law is governed by international conventions. The United Nations Universal Declaration of Human Rights of 1948 declares:
"Everyone has the right to seek and to enjoy in other countries asylum from persecution"
This declaration is supported by the 1951 Convention Relating to the Status of Refugees and the 1967 Protocol Relating to the Status of Refugees. The UK is a signatory to both of these treaties and therefore has an international obligation to grant asylum to those who qualify.
Once asylum is granted, you become a refugee. After you have lived in the UK for five years as a refugee, you may be able to apply for Indefinite Leave to Remain
What is humanitarian protection?
Humanitarian protection is an international form of protection for people who do not qualify for asylum. You may be granted humanitarian protection if you face death or endangerment (for example torture) should you return to your home country.
If you are granted humanitarian protection, you may be able to apply for Indefinite Leave to Remain after five years.
How do I claim asylum?
Once you reach the UK you must contact a border official and state you wish to claim asylum.
To claim asylum, you must provide evidence that you have a serious fear of persecution due to your:
- Ethnic background
- Religious beliefs
- Nationality in your home country
- Political views
- Membership of a social group membership or affiliation
The British government will provide you with a place to live and a small allowance whilst your application is being processed. You will also be entitled to Legal Aid, which will pay for an Immigration Solicitor.
