It is imperative to understand the different wording associated with leases. 

At KLR we understand lease technicalities and assist you to understand what is needed or what you are agreeing to. whether we are acting for the landlord or the tenant.

When the owner of the property or the landlord creates a lease in favour of a tenant, he creates the ‘grant’ of that lease. This is known as the head-lease because the only title above this is the freehold title. Just as the landlord was able to create a lease for himself over the property, the new assignee, can also create a lease thereby creating a sub-lease.

  • What should the new lease contain ?

    Is is important that care is taken when writing a new lease, the wording and the clauses need to be clear and acceptable and all the right clauses are included. 

  • The Plan

    The plan of the property will need to be drawn up properly. The property will need to be detailed and drawn to scale. Then an application to register the new lease can be submitted to the Land Registry for approval. 

  • Prescribed Clauses

    The Land Registry insists that prescribed clauses are included in the lease in order for it to be registered.

  • What is Demised Premises ?

    The lease needs to identify the property, provisions including its ownership of the walls, floors and ceilings are to be included.

  • What is Reservation of Easements ?

    The owner will need to decide if they need to excerise rights over the demised premises, for example access to a driveway, which the owner and other tenants need to use. 

  • What is a typical length or term of a lease ?

    Residential leases are granted from 80 years and more. A lease can be extended after it expires if agreements are followed.

  • Building Insurance

    The landlord is usually responsible for the buildings insurance on the property and then contributions are collected from the tenant in their service charges.

  • Rent Payable

    Rent will be specified in the lease and will remain at the same rate for an agreed time, then it will likely increase in increments thereafter.
