Why do I need to extend my lease?


If you own a leasehold property you must renew your lease before the length of time drops below 80 years. 

This is because in addition to paying for the extension process, you will need to pay the ‘marriage value’ of the property. This is the increase in the value of the property since the last lease extension. It can amount to many thousands of pounds, which is why it is imperative to keep an eye on the length of your lease and start the renewal process once there is 83-82 years left.




What are the requirements for obtaining the ‘right to manage’?


Under the Commonhold and Leasehold Reform Act 2002, owners of leasehold flats have the right to form a company and take over the management functions of the overall building. Management functions can include:


  • services
  • repairs
  • maintenance
  • improvements
  • insurance



To qualify for the ‘right to manage’ the following must apply:


  • The premises / block must be a structurally detached building or self-contained part of a building.
  • There must be at least two flats.
  • At least two-thirds of the flats must be owned by “qualifying tenants”.
  • If part of the building is used for commercial purposes, this must not exceed 25% of the total floor area.
  • At least 50% of the leaseholders in the premises / block must agree to proceed.
  • If your building is a converted property of four or fewer flats, neither the landlord nor an adult member of the landlord´s family occupies one of the flats as their principal residence.
  • The local authority is not the landlord of any qualifying tenant.
